1. Acceptance of Terms

By accessing and using Whim ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the App.

2. Description of Service

Whim is a mobile application that enables users to discover and participate in spontaneous events happening within the next 48 hours in their local area. The service allows users to create, browse, and join events organized by other community members.

3. User Accounts

To use certain features of the App, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Post false, misleading, or fraudulent content
  • Harass, abuse, or harm other users
  • Distribute spam or unsolicited messages
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorized access to the App or related systems

5. Event Creation and Participation

Users who create events are responsible for:

  • Providing accurate event information
  • Ensuring events comply with local laws and regulations
  • Managing event attendance and communication
  • Canceling events if necessary with appropriate notice

Whim is not responsible for the conduct of users at events or for any disputes that may arise between users.

6. Content Ownership and License

You retain ownership of any content you post on the App. By posting content, you grant Whim a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with operating and promoting the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

8. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WHIM DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. WHIM IS NOT RESPONSIBLE FOR THE CONDUCT OF USERS OR THE SAFETY OF EVENTS ORGANIZED THROUGH THE APP.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

10. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms of Service. You may also delete your account at any time through the App settings.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
